Appeal Against a Tax Assessment Notice: One Month to File
Review the decision. Note the deadline. File an appeal. You have one month from the date of notification to do so; if sent by mail, the decision is considered to have been notified on the fourth day after it was mailed. The appeal must be filed in writing or electronically—for example, via ELSTER.
An objection to a tax assessment notice may be filed within one month of its notification (Section 355 of the German Fiscal Code [AO]). If sent by mail, the notice is deemed to have been notified on the fourth day after it was mailed. If the deadline falls on a weekend or a holiday, it is extended to the next business day. The appeal may be filed in writing or electronically.
- The deadline for filing an objection is one month and begins upon notification of the decision (Section 355(1) of the German Fiscal Code (AO)).
- For domestic mail, the notice is deemed to have been served on the fourth day after the mail was posted (Section 122(2)(1) of the German Fiscal Code [AO]); if that day falls on a weekend or a holiday, service is deemed to have occurred on the next business day.
- If the deadline falls on a Saturday, Sunday, or public holiday, the deadline ends on the next business day (Section 108(3) of the German Fiscal Code (AO)).
- The objection may be filed in writing, electronically, or orally for the record (Section 357(1) of the German Fiscal Code (AO)).
- The tax office will review the decision and may amend it to the taxpayer’s disadvantage, provided prior notice has been given (Section 367(2) of the German Fiscal Code (AO)).
How long is the objection period?
The deadline is one month and begins upon notification of the decision (Section 355(1) of the German Fiscal Code (AO)). For domestic mail, the decision is deemed to have been notified on the fourth day after it was mailed (Section 122(2)(1) of the German Fiscal Code (AO)). The date the notice is mailed is decisive, not the date on the notice itself. If the notice is not received at all or arrives late, the actual date of receipt applies. In case of doubt, the tax office must prove the receipt and the time of receipt.
The deadline is calculated in accordance with the provisions of the Civil Code (Section 108(1) AO): The day of notification is not included; the deadline ends at the close of the day in the following month that bears the same number; if there is no such day in the following month, the deadline ends on the last day of that month. If the deadline falls on a Saturday, Sunday, or legal holiday, it ends on the next business day (Section 108(3) of the German Fiscal Code (AO)).
The same rule applies to the date of notification: If the fourth day falls on a Saturday, Sunday, or legal holiday, the decision is not considered to have been notified until the next business day, and the one-month period begins accordingly later. Example: Mailed on Wednesday, November 4, 2026. The fourth day is Sunday, November 8, 2026; therefore, the notice is deemed to have been served on Monday, November 9, 2026, and the deadline ends on Wednesday, December 9, 2026.
Model calculation: The notice will be mailed on Monday, November 2, 2026
- Mon, Nov. 2, 2026
Mail the assignment
The assumed date on which the tax office sends the notice.
- Fri, Nov. 6, 2026
Announcement
Fourth day after dropping it off at the post office.
- Sun, Dec. 6, 2026
Calculated Deadline
One month after the announcement, on a Sunday.
- Mon, Dec. 7, 2026
Actual Expiration Date
The next business day after Sunday.
The deadline does not begin without notice of the right to appeal
The one-month period begins only if the notice provides information regarding the appeal, the agency and its location, and the deadline to be observed, in the same form used for the notice itself. If this information is missing or incorrect, the appeal may be filed within one year of the notice’s issuance.
Which items on the tax assessment notice are important?
You can skim through a tax assessment notice to get the gist of it in just a few minutes. If the tax office has made adjustments to your tax return, the notice will typically mention this in the explanatory notes. That’s where you should look first, because that’s where it explains which details were treated differently.
Reviewing the Decision: The Points That Matter
- The name, tax ID number, and tax year are correct.
- Marital status, tax filing status, and number of children are as stated in the declaration.
- The wages correspond to the wage tax statement.
- The reported income-related expenses, special expenses, and extraordinary expenses have been taken into account.
- Any deviations from the statement are explained in the notes.
- The notes regarding the provisional nature of the decision have been read, as have the payment instructions.
- The date, payment due date, and information on legal remedies have been noted.
How do I file an appeal?
The appeal may be filed in writing, electronically, or orally on the record at the tax office (Section 357(1) of the German Fiscal Code (AO)). The word “objection” does not have to appear on the document; what matters is that it is clear who is filing it. The statutory text does not require a signature. The objection must be addressed to the authority whose decision is being challenged. If the objection is received by an unauthorized office, this is not a problem as long as it is forwarded to an authorized office before the deadline expires (Section 357(2) of the German Fiscal Code (AO)). However, you bear the risk that it will arrive there in time.
ELSTER has a specific form for this: “Submit an Appeal, Including a Stay of Enforcement.” It can be found after logging in to Mein ELSTER.

Does the objection have to be substantiated?
A statement of grounds is part of the appeal, but under the law it is a discretionary requirement (Section 357(3) of the German Fiscal Code (AO)). The appeal must identify the contested decision, specify the scope of the challenge and the relief sought, and set forth the facts and evidence. According to § 357(1) AO, the appeal is deemed valid as soon as it is clear who is filing it. The law does not make the validity of the appeal contingent on a complete statement of grounds. It is possible to submit the statement of grounds later, but only as long as the tax office has not set its own deadline for doing so.
If a tax assessment notice contains multiple assessments—such as for income tax, the solidarity surcharge, and church tax—the appeal applies only to those against which your objections are directed. If you only contest the solidarity surcharge, you have not contested the income tax or church tax. If necessary, the tax authority will interpret your intent to determine what you meant; however, you should not rely on this. Therefore, explicitly state which assessment you are contesting.
The tax office may set a deadline for submitting the missing information
The tax office may set a deadline for you to state the facts, provide explanations regarding issues requiring clarification, or identify evidence. Anything submitted after that deadline will not be taken into account. The tax office must expressly point out this consequence, and the deadline must be at least one month. This typically occurs when the assessment is based on an estimate because no tax return was filed.
The deadline can be extended only if the application is received before it expires. After that, the only option left is reinstatement.
Payment and Stay of Execution
An appeal does not suspend payment; the assessment remains enforceable (Section 361(1) of the German Fiscal Code (AO)). Upon request, the tax office shall suspend enforcement if there are serious doubts as to the legality of the decision or if it would cause undue hardship (Section 361(2) of the German Fiscal Code (AO)).
This is not free: If the appeal is ultimately unsuccessful, interest will be charged on the suspended amount at a rate of 0.5% for each full month, or 6% per year; partial months are not counted. Interest accrues from the date the appeal is received—or, if the suspension is granted later, from the start of the suspension—until the end of the suspension. The amount on which interest is calculated is rounded down to the nearest amount divisible by €50.
In the case of tax assessment notices, the suspension is limited to the assessed tax, reduced by any allowable deductions and assessed advance payments. Anyone who disputes €10,000 but is only required to pay an additional €1,200 will have at most this €1,200 suspended, unless the suspension is necessary to avert significant disadvantages. In addition, the tax office may make the suspension contingent upon the provision of security.
What happens after an appeal is filed?
The tax office will conduct a completely new review of the matter (Section 367(2) of the German Fiscal Code (AO)). If the appeal is upheld, the tax office will amend the assessment. If the appeal is not upheld or is only partially upheld, a decision on the appeal will be issued. The appeal may be withdrawn until the decision is announced (Section 362 of the German Fiscal Code (AO)).
If the tax office amends the decision while the appeal is pending, the new decision automatically becomes the subject of the pending proceedings. A second appeal is not necessary, and the original appeal remains pending. This also applies if a decision is corrected due to a manifest error or replaces an invalid decision.
An appeal against the objection decision may be filed with the tax court; the deadline for filing the appeal is specified in the notice of appeal rights included in the decision.
Could the decision be less favorable as a result of the appeal?
Legally, this is possible. Because the tax office is conducting a completely new review of the matter, it may also amend the decision to the taxpayer’s disadvantage. In such cases, it must first notify the taxpayer of this possibility, state the reasons, and provide an opportunity to comment (Section 367(2) of the German Fiscal Code (AO)). As an exception, this notice is not required if the adverse change could not have been avoided by withdrawing the appeal in the first place. After receiving this notice, the appeal may still be withdrawn as long as the decision on the appeal has not yet been issued (Section 362 of the German Fiscal Code (AO)).
Withdrawal brings the opposition proceedings to an end, and the opposition filed is deemed withdrawn. This does not mean the matter is settled: a change to the applicant’s disadvantage remains possible even after that, to the extent that the general grounds for correction apply.
Worsening – If, during an appeal proceeding, the tax office amends a decision to the detriment of the appellant. This may only be done after prior notice has been given, stating the reasons and providing an opportunity to comment.
Quick question, quick answer.
How long do I have to file an appeal against the tax assessment notice?
One month from the date of notification (Section 355(1) of the German Fiscal Code (AO)). For domestic mail, the notice is deemed to have been served on the fourth day after it was mailed, and the deadline expires one month later. If the deadline falls on a weekend or a holiday, it expires on the next business day.
When is a tax assessment notice considered to have been served?
For domestic mail, on the fourth day after posting; for international mail, one month thereafter (Section 122(2) of the German Fiscal Code (AO)). If this day falls on a Saturday, Sunday, or legal holiday, the notice is deemed to have been served on the next business day. If the notice arrives later or not at all, the actual date of receipt applies, and in case of doubt, the tax office must prove receipt and the date thereof.
Can I file the appeal through ELSTER?
Yes, in Mein ELSTER there is a form titled “Submit an Appeal, Including a Stay of Enforcement.” There, you can enter the grounds for your appeal and attach supporting documents. The law expressly permits electronic appeals (Section 357(1) of the German Fiscal Code (AO)).
Do I have to pay while the appeal is pending?
Yes, the appeal does not suspend enforcement (Section 361(1) of the German Fiscal Code (AO)). Upon request, the tax office may suspend enforcement, for example, if there are serious doubts as to the legality of the assessment (Section 361(2) of the German Fiscal Code (AO)). If the appeal is ultimately unsuccessful, interest of 0.5% per full month will be charged on the suspended amount.
Can I withdraw the objection?
Yes, until the decision on the objection is announced (Section 362 of the German Fiscal Code [AO]). After that, withdrawal is no longer possible. Withdrawal terminates the objection proceedings, and the objection filed is deemed withdrawn. However, a change to the taxpayer’s disadvantage remains possible to the extent that the general correction provisions apply.
What happens if the objection period has expired?
Anyone who has missed the deadline through no fault of their own may apply for reinstatement to the previous status (Section 110 of the German Fiscal Code [AO]). The application must be filed within one month after the obstacle ceases to exist; the reasons must be substantiated; and the objection must be filed within this period. Once this has been done, reinstatement may be granted even without a separate application. The fault of a representative is attributed to you: the advisor’s error counts as your own. The deadline is one year after the end of the missed deadline at the latest, except in cases of force majeure.
